Tenancy and Leasehold Agreements

Residents will occupy their property on a variety of tenancy or leasehold agreements.
- An assured tenancy for a period of less than seven years such as a weekly, monthly or quarterly tenancy;
- An assured shorthold tenancy usually for a minimum period of six months;
- A secure tenancy for a period of less than seven years such as a weekly, monthly or quarterly tenancy;
- A regulated tenancy for a period of less than seven years such as a weekly, monthly or quarterly tenancy;
- A lease for a period of years often 99 years for shared ownership or 125 years if granted under the provisions of the Housing Act 1985 in respect of the right to buy or the Housing Act 1996 in respect of the right to acquire.
Irrespective of the period of the tenancy agreement or length of lease, there should be clear statements in the tenancy agreement or lease about services (including TV aerial systems) to be provided by the landlord.
- A covenant by the landlord to provide the services (these should be listed in the tenancy agreement or lease either as a separate schedule or within the body of the agreement);
- The ability of the landlord to recover the cost of providing the services thus identified through the service charge; and
- A covenant by the tenant or leaseholder to pay for the services provided.
In some tenancy agreements, usually houses, landlords specifically pass the responsibility for the provision and maintenance to the tenant.
